Terms of Service

1. Agreement to these terms

These Terms of Service (“Terms”) govern your access to and use of Workser Business, Workser Desktop, and related services (together, the “Services”) provided by [Workser’s legal entity name] (“Workser,” “we,” “us”). By creating an account or using the Services, you agree to these Terms. If you’re using the Services on behalf of an organization, you’re agreeing on its behalf and confirming you have authority to do so.

2. What Workser provides

Workser Business lets you build web apps, workflow automations, and AI Employees (autonomous agents that operate software and data on your behalf) inside a project-based workspace with its own database, storage, and hosting.

Workser Desktop is a desktop application that gives an AI agent computer-use capabilities you explicitly approve (screen viewing, mouse/keyboard control, file and browser automation), and includes Orbit, a bring-your-own-key bridge between the coding-agent CLIs you already run (currently Claude Code, Codex, OpenCode, Cursor, and Muse Code) and Workser’s deploy/hosting infrastructure.

3. Accounts

You must provide accurate information when creating an account and keep your credentials secure. You’re responsible for activity under your account, including actions taken by AI agents you configure. Organizations may invite members with different roles (owner, admin, member, viewer); the organization owner is responsible for managing membership and access.

4. Acceptable use

Full detail is in our standalone Acceptable Use Policy. In summary, you agree not to use the Services to:

  • Violate applicable law, or infringe anyone’s intellectual property, privacy, or other rights.
  • Attempt to bypass or interfere with security controls, sandbox isolation, or access-control mechanisms.
  • Use an AI agent to attempt prompt injection, data exfiltration, or unauthorized access to systems you don’t own or haven’t been authorized to access.
  • Use computer-use or Orbit capabilities to take actions on a device or account you’re not authorized to control.
  • Resell or provide the Services to third parties without our prior written consent, except as expressly permitted by your plan.

5. Your content and AI output

You retain ownership of the content you provide to the Services (“Customer Data”) and the outputs your AI agents generate (“AI Output”). You grant Workser a limited license to use, process, and store Customer Data and AI Output solely to provide, support, and improve the Services for you, as described in our Privacy Policy. We do not use your Customer Data or AI Output to train models for our general product or for other customers without your prior written consent.

6. AI agents and autonomous actions — please read carefully

Workser’s AI Employees and computer-use agents can take real actions on your behalf — writing and running code, calling connected third-party apps, controlling your computer, and more. We build in safeguards (sandboxed execution, secret redaction, prompt-injection guardrails, and approval prompts for computer-use actions), but AI systems can make mistakes.

You’re responsible for reviewing and approving agent actions where the Services request your approval, for configuring appropriate limits (e.g. per-user credit limits, connected-app scopes) for your organization, and for the consequences of actions your agents take within the scope you’ve granted them. Don’t grant an agent access to systems or data where an error would cause harm you’re not prepared to accept.

7. Third-party integrations and AI providers

The Services connect to third-party applications and AI model providers (see our Security & Trust page for the current subprocessor list) to operate. Your use of a connected third-party app is also subject to that provider’s own terms. Under Orbit’s bring-your-own-key model, code generation is handled by the coding-agent provider you’ve connected, under your agreement with that provider, not Workser’s.

8. Fees, credits, and billing

Paid plans are billed through Stripe on the cycle and terms shown at checkout. AI-driven actions consume credits from your organization’s credit balance; you can configure auto-topup or purchase credits manually. Fees are non-refundable except as required by law or expressly stated at time of purchase. We may change pricing with advance notice before your next billing cycle.

9. Suspension and termination

You may stop using the Services and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms, including the acceptable use provisions above. On termination, you may export your Customer Data within the window described in our Privacy Policy, after which we will delete it from active systems per our standard data deletion process.

10. Disclaimers

The Services, including AI-generated output, are provided “as is” without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement. AI Output may be incorrect, incomplete, or unsuitable for your purposes — review it before relying on it for decisions with real consequences.

11. Limitation of liability

To the maximum extent permitted by law, Workser will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Services. [Legal: insert liability cap and any jurisdiction-specific carve-outs.]

12. Governing law

13. Changes to these terms

We may update these Terms from time to time. We’ll notify you of material changes through the Services or by email before they take effect. Continued use after changes take effect constitutes acceptance.
